Terms of Service

1. Acceptance of Terms

By accessing or using Mockably, you agree to be bound by these Terms of Service. You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) to use this service. If you do not agree to these terms or do not meet the age requirement, do not use our service.

If you sign up or log in using Google or Facebook, you agree to these Terms of Service and our Privacy Policy. If you create your account with Google or Facebook, you also agree to receive marketing and promotional communications until you turn them off in Settings.

2. Use of Service

You may use Mockably to create mockups for your products. You agree to:

• Only upload designs you have the right to use
• Not use the service for illegal purposes
• Not attempt to reverse engineer or exploit the service
• Not share your account credentials with others

3. Intellectual Property

You retain all rights to the designs you upload. The mockups generated using your designs are yours to use commercially. Mockably retains rights to the platform, AI technology, and generated scene elements.

4. Credits and Billing

Credits are used to generate mockups. Different credit types (e.g. subscription, top-up, verification) may have different expiration rules; subscription credits expire at the end of the current billing period if your subscription is cancelled or not renewed. We reserve the right to modify pricing, plans, and credit policies at any time; we will give notice where required by law or where changes materially affect you. We do not refund credits for results you are dissatisfied with (including AI output quality or style).

Mockups are generated using AI. AI-generated images can occasionally contain errors or imperfections; we do not refund credits for such results. If a generation fails due to a server or system error, we will refund the credits used for that job.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Mockably is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including unsatisfactory AI-generated output, service unavailability, or loss of data. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim.

6. Account Termination

We may suspend access (for example for past-due payment or suspected abuse) or terminate accounts that violate these terms or engage in prohibited activities. You may delete your account at any time through your account settings; deletion is subject to the 30-day reactivation period described in our Privacy Policy.

7. SMS and Text Messaging

When you request an account verification code, you consent to receive transactional SMS messages from Mockably for that purpose. We send SMS only when you actively request verification; we do not send marketing or promotional texts. Standard message and data rates may apply.
